Terms of Service

Applicability of Apple Standard EULA

This app is licensed to you under the Apple Standard End User License Agreement (EULA). The Apple EULA governs your use of this app. The additional terms below supplement the Apple EULA. In the event of any conflict between the Apple EULA and these additional terms, the Apple EULA will control.

1. Acceptance of These Terms

By downloading, installing, or using Queenright ("App"), you agree to be bound by these Terms of Service ("Terms") entered into between you and Pepin LLC ("Queenright," "we," "us"). If you do not agree, do not use the App.

2. Who May Use the App

• You must be at least 16 years old and capable of forming a binding contract. Users under 16 may use the App with parental or guardian consent.
• You may create only one account per individual.

3. Your Account

You must provide a valid email address and keep it up to date. You are responsible for all activity that occurs under your login.

4. Subscriptions, Billing & Platform Refunds

• Free tier: unlimited hives and inspections.
• Pro tier: monthly or annual auto-renewing subscription with additional features.
• All payments are processed through Apple App Store or Google Play. Queenright does not directly handle billing or process refunds. For refund requests, payment issues, or subscription management, please contact Apple (via your account settings or their support) or Google Play (via your account settings or their support).
• To cancel your subscription, visit your app store's account settings and manage your subscriptions directly. Cancellation takes effect at the end of your current billing period.
• For detailed refund policies, refer to your app store's billing policies (Apple App Store or Google Play Store).

5. License & Intellectual-Property Rights

We grant you a limited, revocable, non-transferable license to use the App for beekeeping management. All rights not expressly granted remain with Queenright and our licensors.

6. User Content

"User Content" includes audio clips, photos, hive data, and other materials you upload.

• You retain ownership of your User Content.
• You grant Queenright a worldwide, royalty-free license to host, process, store, and display your content for the purpose of providing the Queenright service.
• You represent that you have all rights necessary to upload the content and that it does not infringe any third-party rights.
• If you share an apiary or hive with another user, that user will see all associated data.

7. Prohibited Conduct

You agree not to:

1. Resell, reverse-engineer, or attempt to bypass security or app integrity checks.
2. Upload unlawful, harmful, or infringing content.
3. Engage in excessive or abusive calls to our APIs, databases, or network that degrade service.

Queenright may suspend or terminate accounts that violate these rules or otherwise abuse the service.

8. Informational-Only Disclaimer

Any advice or recommendations generated by Queenright (including future AI-based suggestions) are for informational purposes only. You remain solely responsible for your beekeeping decisions.

9. Limitation of Liability

To the maximum extent permitted by law, Queenright will not be liable for indirect, incidental, special, or consequential damages, or any loss of data, profits, or goodwill, even if advised of the possibility. Our total liability for any claim is limited to the amounts you paid to us in the 12 months before the claim.

10. Indemnification

You will indemnify and hold Queenright harmless from any claim or demand arising out of your use of the App, your User Content, or your violation of these Terms.

11. Governing Law & Dispute Resolution

• These Terms are governed by the laws of the State of Wyoming (USA) without regard to conflict-of-law principles.
• Any dispute arising from or relating to these Terms or your use of the App shall be resolved in the state or federal courts located in Sheridan County, Wyoming. You and Queenright each consent to the exclusive jurisdiction and venue of these courts.
• Before pursuing legal action, we encourage you to contact us at support@queenright.app to attempt to resolve the dispute informally.

12. App Store Terms

This app is distributed through the Apple App Store and Google Play Store. Your use of this app is also governed by the terms and policies of these platforms. In the event of any conflict between these Terms and the app store terms, the app store terms will control with respect to your relationship with the app store. Queenright is solely responsible to you for providing the app and supporting your use of it, subject to these Terms and any applicable app store agreements.

13. Termination

You may stop using the App at any time. We may terminate or suspend access for any breach of these Terms. Sections 6 – 13 survive termination.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted in-app or on our website. Continued use after the effective date constitutes acceptance.
